1. Who is responsible for your data


Bryer Education Limited, company number 80745123, registered at Unit 909, Prosperity Millennia Plaza, 663 King's Road, Quarry Bay, Hong Kong, is responsible for personal data collected through this website and in the course of our services.

2. What we collect


From the Client, meaning the parent or guardian

● Name, email address, telephone number, messaging handle such as WeChat or WhatsApp, country and time zone

● Billing information and payment records


From or about the Student

● Name, school, year group and subjects studied

● Academic information such as predicted grades, past scores, work submitted for feedback, and progress notes

● Age or date of birth, where needed to confirm that a parent or guardian is contracting

● Audio and video recordings of every lesson, including the Student's image and voice and anything shared on screen


Automatically from this website


● IP address, browser type, pages viewed, referring page and similar technical information


We do not collect or store your full card number. Card payments are handled directly by our payment provider under its own privacy terms.


3. Children's data


● We collect the minimum personal data about a Student that is necessary to teach them well.

● Where the Student is under 18, we rely on the consent and instruction of the parent or legal guardian.

● We do not market directly to Students.

● We record every lesson. Because a recording captures a child's image and voice, we treat it as sensitive personal data. We obtain the parent's or guardian's written consent before the first lesson, we never use a recording containing a Student for marketing or promotion, and we delete recordings after 12 months.

● Parents and guardians may ask at any time to see, correct or delete the information we hold about their child, subject to any record we are required to keep for accounting or legal reasons.


4. Why we use it


● To provide instruction, schedule lessons, mark work and give feedback

● To take payment and keep accounting records

● To communicate with you about your engagement

● To improve our teaching and this website

● To comply with our legal obligations

● To send you information about our services where you have asked us to, which you can stop at any time


5. Who we share it with


We share only what is necessary, with:


● Payment processing: Airwallex, for taking and reconciling payment

● Video conferencing: Zoom, for delivering lessons

● Recording storage: our encrypted storage provider in Hong Kong

● Website hosting and email: our hosting and email providers

● Messaging platforms: WeChat and WhatsApp, where you choose to contact us that way

● Professional advisers: our accountants, and lawyers if ever needed

● Authorities: where we are required to by law


We do not sell personal data. We do not share it for anyone else's marketing.


6. Where your data is stored, and international transfers


● Lesson recordings are stored in encrypted form on servers located in the Hong Kong Special Administrative Region. They are not kept on the video conferencing provider's cloud.

● Teaching records, progress notes and correspondence are held in Hong Kong or by service providers acting on our instructions.

● Some service providers necessarily operate internationally. Payment processing, video conferencing and messaging involve systems that may sit outside Hong Kong, including in Singapore, the European Union and the United States.

Because our Students are in several countries, personal data crosses a border to reach us. Where that happens we take reasonable steps to ensure it remains protected to a standard comparable to that required in Hong Kong, including by contract with our providers.

If you are in mainland China: Hong Kong is a separate jurisdiction for data protection purposes, so providing your personal information to us is a cross-border transfer under the Personal Information Protection Law. We ask for your separate consent to that transfer, we tell you what will be done with the information and who will hold it, and we limit what we collect to what is necessary to teach the Student. Where the Student is under 14, we obtain the consent of the parent or legal guardian.


If you are in the United Kingdom or the European Union: Hong Kong is not covered by a UK or EU adequacy decision. Where we receive your personal data we rely on appropriate contractual safeguards and on your explicit consent to the transfer.


7. How long we keep it


● Lesson recordings: 12 months from the date of the lesson, unless you ask us to delete them sooner

● Teaching records and progress notes: for the duration of the engagement and 2 years afterwards

● Accounting and payment records: 7 years, as required by Hong Kong law

● Marketing contact details: until you ask us to stop


8. Security


We use encrypted connections and encrypted storage, access controls and password protection, and we limit access to personal data to those who need it. No system is perfectly secure, but we take this seriously and we will tell you promptly if a breach affects you.


9. Your rights


Under the Hong Kong Personal Data (Privacy) Ordinance you may ask us to confirm whether we hold data about you, to give you a copy, and to correct anything inaccurate. Write to james@bryereducation.com and we will respond within 40 days.

If you are in mainland China, the Personal Information Protection Law may also give you rights to access, correct, delete, restrict or transfer your personal information, to withdraw consent, and to an explanation of how we handle it.

If you are in California, the CCPA and CPRA may give you rights to know what we collect and why, to delete it, to correct it, and to opt out of sale or sharing. We do not sell or share personal information as those terms are defined, and we will not discriminate against you for exercising these rights.

If you are in the United Kingdom or European Union, the UK GDPR or GDPR may give you rights of access, rectification, erasure, restriction, portability and objection, and a right to complain to your local supervisory authority.

To exercise any of these, contact james@bryereducation.com. We may need to verify your identity first.


10. Cookies


This website uses cookies necessary for it to function, and may use analytics cookies to understand how the site is used. You can control cookies through your browser settings. Blocking all cookies may stop parts of the site working.


11. Complaints


Contact us first at james@bryereducation.com. If you remain dissatisfied, you may complain to the Office of the Privacy Commissioner for Personal Data, Hong Kong, or to the supervisory authority in your own country.


12. Changes


We may update this policy. The date at the top shows when it last changed.
